topping our news this morning, police are in walnut creek despite an arrest over three previous attacks at the same location. all four assaults were reported at the park regency. we have jade hernandez with more on the reaction. >> reporter: the alarming part of the story is not even that another sexual assault happened at park regency or that it is being considered a home invasion this morning. it is one man is already behind bars and still behind bars this morning in connection with three others. who is responsible for the sexual assault last night? the complex used to have one guard on duty. management hired a few more after the last assault. all of the assaults have taken place since late june. the latest last night happened

at 6:00. a woman told the sheriff's office she was attacked while inside her apartment. the sheriff's officer told us last night that the man followed the woman through the gates of the apartment and into her apartment where he sexually assaulted her. >> i thought they caught the guy and it was all okay. i guess it is not. >> reporter: this is the man still behind bars in connection with the three other assaults at park regency earlier this summer. antonio mutan. his family claims he was innocent, but dna testing linked mutan to one of the rapes. we will have more from the sheriff's office this morning. reporting live, jade hernandez, ktvu channel 2 news. 5:02. in other news, there are several developments in the pipeline. fire and explosion in san bruno. pg&e was worried last year that

liquids were corroding four pipelines, including the one that blew up last week. the doctor said the seven people seriously burned in the pipeline disaster are facing a long and painful road to recovery. the smell of gas prompted evacuations yesterday in san bruno and san francisco and oakland. the bullis family released a statement. they are the three people still listed as missing. "it is with heavy hearts that we announce the passing of levan and greg and william. it is with hope and love that we wish to see this community rebuilt." the funeral for the mother and daughter killed in the pipeline explosion will be held at st. cecelia's church in san francisco. last night, family and friends gathered for a rosary service

for jacklin and greg and her 13- year-old daughter. >> she was the person that was a role model to everyone. i know all of the kindergarteners look up to her. i saw her and i could be like her. >> she would walk down the hall and say hello to everybody. whether they are a k indergartener or a teacher. >> more than 1,000 people filled the church for the vigil. this morning, funeral services starts -- vigil. this morning, funeral services start at 11:00 a.m. in san francisco. last night, family and friends gathered to remember another victim. jessica morales was watching football at the time of the explosion with her boyfriend. she was killed and her boyfriend was seriously burned. her funeral will take place in san bruno.

city officials in san bruno have officially declared a local state of emergency. that unanimous vote came last night during the special meeting at city hall. the declaration will release more state and federal assistance. city officials say the devastating fire has changed san bruno forever. >> i think the situation has changed the community in ways that we probably don't yet even have the ability to perceive. >> last night's city vote follows the state of emergency already declared by state lawmakers in sacramento. a 19-year-old man is facing serious charges after leading highway patrol officers on a chase in downtown san jose that killed two other people. police pulled over the man because of a myselfing license plate. as -- missing license plate. as the officers got out of the patrol car, the suspect took

off. he crashed at st. james and north 6th street. >> unfortunately, the end result was two passengers suffered fatal injuries. the driver and front passenger suffered non-life threatening injuries. >> police are investigating why he fled from police. time is 5:05. relief is on the way for some commuters for next monday's opening of the bay area's first toll express lane. the stretch of 680 runs between highway 84 and highway 237 in milpitas. tolls will be collected using fastrak. you can access the lane at a cost of $4 to $6. car poolers will get a free ride, but you need to cover up your fastrak trans ponders to avoid being charged. you can find out more about the fastrak lanes and how it will

and the economic team giveth. all of the spending is one of the reasons why. >> reporter: the white house will release the full list of stimulus successes later today. we will look for local projects. so far, the feds awarded california $23 billion in stimulus money. that has created 76,000 jobs. reporting live from washington d.c., alison burns, ktvu channel 2 news. a san francisco man has admitted to making threatening phone calls to house speaker nancy pelosi. a plea deal in federal court calls for 48-year-old greg jusi to stay away from pelosi and her family and staff when he is released from prison. jusi admitted to making more than 40 harassing phone calls to her home and offices. he is angry over her support for health care reform. time is 5:15. the government lawyers this morning will ask an appeals

court in washington d.c. to throw out a judge's order to release a guantanamo bay prisoner who is accused of recruiting 9/11 hijackers. the judge said the man salahi arranged travel after being abused by interrogators. he was sent to guantanamo bay in 2001. the 9/11 commission report said he was a significant al-qaeda operative. all right. 5:16 is the time. let's check in with sal for a look at the commute. >> we are checking the fire, pam and dave, in bay point area near highway 4. near ambrose park. we could almost see it here from the bay point picture. it is just around the corner. it is near ambrose park.

it was a significant fire. 1.5 acres involved. one home was briefly threatened. kraig debro is there. he will have new details on the fire. most firefighters that they called in had a heavy response. most are beginning to leave now. that is good news. it seems they have it under control. we will find out more coming up. let's look at highway 24 west as you drive up to the tunnel. that traffic is moving along well. at the toll plaza. it is still light. here is steve. thank you. there is the first system of the season. it will weaken as it moves in. first one usually doesn't do too much. it is there and it will produce rain in northern california today. clouds increase ahead of that for those along the coast. tomorrow, for the north bay and everybody for sunday morning. drizzle is out there right now. also an increase in the low clouds. fog and drizzle and 60s and 70s and 80s. we get a south wind.

that puts a bit of moisture in the air in the form of muggy humid. look at the lows. upper 50s to 67 in san jose. 63 in concord. it will not take long to warm up once you get past the fog. 50s up and down the coast. eureka with the clouds. the front will weaken considerably. the key is the low. we will have a better opportunity for rain on saturday. fog and drizzle and sunny and mild. a south wind for many starting to show up. that can be a very mild direction for some ahead of the system. drizzle is. there 60s and 70s -- drizzle is there. 60s and 70s. we will have mid-60s there and

mid-80s an -- away from the coast. cloudy on saturday. rain in the north bay. this system will fall apart as it moves south. another cooldown on tuesday. overnight, global stock markets moved higher. economic growth in asia is expected to remain well above other parts of the world with china predicted to span 10% in the coming year. the markets in japan and hong kong and south korea each rose about 1%. the markets in europe are up in early trading. technology is in the spotlight on wall street. good earnings reports are expected to drive stocks up. dow jones industrial average is starting at 10,934 today. oracle is posting better than effected quarterly profited. the company produced $1.4 billion up 20% from the same

time last year. earning analysts after signing new contracts. research in motion posted strong quarterly profits. uc regents approved building a $1.5 million hospital in san francisco. the location is mission bay. it has been more than 40 years since a new hospital has been in san francisco. the hospital will be dedicated to the health care of women, children and cancer patients. this hospital is due to open in four years. there are hopeful signs on the state budget impasse. >> the governor did not bring out the sword. >> how soon the long delayed budget could finally be passed. and an 18-year nightmare. jaycee dugard's relatives should look elsewhere for restitution. the suggestion given to the kidnapped victim's mother.

of mexico is a step closer to being sealed. the next step is to pump mud and cement down the well to seal the broken well at the base. the final seal is expected to be finished by sunday. the state of california rejected a compensation claim by the mother of kidnapping victim jaycee dugard. the state's failure to find her daughter created a nightmare that lasted 18 years. the state department of corrections says terry probyn should take her claim to the courts and file an official lawsuit. the state has already paid jaycee dugard $20 million. her mother was not included in the settlement. at 11:30 this morning, state budget negotiations will continue in sacramento. leaders met for three hours last night. that is the longest meeting they had in three months. afterwards, there were signs an agreement may be near. >> a very good session.

we have a few more things to talk about and we are hopeful to be done tomorrow or the weekend. >> state lawmakers are now in record setting territory. today marks the 79th day of the impasse. the longest they have gone without approving a spending plan. the budget stalemate is effecting thousands of non- profits. many cannot make payroll because they rely on state money which has stopped. allied service has not been able to pay its staff for two months. >> it is very frustrating because you feel like you don't have a voice and no one is listening to you and there is no sense of urgency. >> so far, the state has more than $3 billion in overdue payments to social services and

small fire could have been larger. a lot of wind. it happenednextt to the pittsburg bart station. this is what was burning, but a little taller. we heard the call at 4:15 this moing. firefighters got on the here and they found out the fire started in a valley next to the park and behind a home. i talked to a firefighter out here. he believes it started in a homeless encampment. witnesses said they saw several homeless people running from the fire. they put the fire out in less than 20 minutes. it threatened one home. there is a lot of wind here. they were lucky enough to catch it before it could jump the road and possibly cause more damage or some damage to any home in the first place. fire is out now. we have the last crews leaving the scene here. they were on the scene for a

second just to make sure it did not reach the homes. the wind could have blown an ember over the road. they stayed and now it looks like they are pulling out confidently that they got the last flames out. reporting live, kraig debro, ktvu channel 2 news. another sexual assault has been reported in a walnut creek apartment complex where three previous attacks were reported. sheriff's officers say a woman was assaulted at the park regency on oak road at 6:00 last night. the suspect followed the woman through the gates and attacked her in her apartment. three other women were attacked between june 30th and august 10th. 22-year-old antonio mutan is in jail for the attacks.

his family says he has been falsely accused. our time is now 5:31. we have a sad update to the search for victims of the san bruno explosion. the bullis family released a statement saying the remains of levan and greg and william have been recovered. the three are officially listed as missing. we have claudine wong with the latest. >> reporter: we are in san bruno at this hour where clean up will continue today. we are in the process of he can saying good-bye to victims lost in the tragedy. funeral services will be held for jacklin and her daughter. last night, more than 1,000 people filled st. cecelia's in san francisco. friends describe her as a role model who always had a smile on

her face. they described her mother as a devoted one. they are survived by her husband and oldest daughter who were not home at the time. >> they are in god's hands. it is the holes in our heart that need healing and need to be filled. >> reporter: a vigil also took place last night in remembrance of 20-year-old jessica morales. she was home watching football with her boyfriend when the blast hit. he is still in the hospital with severe burns. friends lit candles and held a moment of silence for the survival and mourn the loss of jessica morales. >> i thank everybody for their love. i know that you recognize me and i know you know who my daughter is and just you looking at me and giving me a smile of encouragement, that

means a lot to me. >> reporter: the funerals for the two will begin at 11:00 this morning in san francisco. jessica morales' funeral will be held tomorrow. this is a difficult time for the community. with all this damage, we are profoundly reminded of the greatest loss in all of this. claudine wong, ktvu channel 2 news. >> the seven people who were burned in the pipeline disaster face a long and painful road to recovery. four of the victims are being treated here at the burn unit at san francisco's memorial hospital. they will move to another phase of the treatment that will likely require surgery. we need to get rid of and remove the scar tissue. the non viable tissue is a source of infection. >> the three other burn patients are being treated at san francisco's general hospital. doctors are not say the extent

of the injuries. they are citing patient privacy laws. there is new evidence the pipeline disaster has many people on edge. three times, crews ordered emergency evacuations. one scare happened here lake merritt when a crew installing a telephone line cut into a gas pipe. >> i saw a firefighter coming up and told me to evacuate. i left all my stuff. >> the smell of gas prompted a false alarm at a san bruno school that is not far from the disaster zone. there was a similar scare at san francisco's gallellio high school. 5:35. pg&e is firing a company that is cleaning up. pg&e says any current work the company is doing will be completed, but they will not be

hired for any additional clean up work. we will keep following the san bruno fire and explosion all morning long. you can get updates anytime by going to ktvu.com. a gunman who opened fire on a car in antioch is still on the loose this morning. the shooting happened on summerville road at delta fair boulevard yesterday morning. the victim, a 34-year-old man from sacramento, was hit in the back, but is expected to be okay. he told police that the suspect drove a white four door sedan and shot at him while he was stopped at a red light. bart is on track to expand. the board of directors awarded the contract to build the project. bart trains would run on elevated tracks from the oakland coliseum to the airport. the project carries a $480 million price tag. time is 5:36. let's see what is happening in the commute. sal. >> we are looking at the east

violent incidents, including a deadly shooting at suede nightclub earlier this year. they want more outside lighting. pleasant hill police are looking at a takeover robbery at a video game store. it happened wednesday night. three masked men robbed the gamestop store. the suspect stole wallets and cell phones from the customers. the same men may be responsible for similar robberies over the past few weeks in pleasant hill and concord. investigators are dealing with another robbery in the east bay. this one at a movie theater. it happened at the contra costa theater. a middle-aged man confronted three in the office and stole cash. he is 6' tall and weighing 170 pounds with short brown hair. he was wearing a dark blue zipper sweatshirt and jeans.

white house. this is how the photo appeared in a state run egypt newspaper. our time is 5:45. the cartoonist in seattle has gone into hiding now after a warning from the fbi. that cartoonist published an illustration called "everybody draw muhammad" day. the fbi told the cartoonist that a muslim cleric said on a web site that she was a prime target. hurricane karl is getting stronger as it heads to ports in mexico's gulf coast. it has drenched cancun earlier this week as a tropical storm. it caused severe flooding and tore down the tree limbs. since then, it has grown into a powerful category three hurricane with winds packing 120 miles an hour. it could still get stronger before it makes landfall later today. check this out. the cleaning up in new york

city where a fierce storm ripped through the city. yesterday's storm knocked down trees on to roadways and actually crushed a driver to death and injured a passenger. rail service was already suspended for hours and that caused havoc in the evening commute. the national weather service is investigating whether that storm was really a tornado. police think a man was distraught about his mother's health before he shot the doctor and his mother and himself. 50-year-old warren davis pulled out a gun and shot the orthopedic surgeon in the stomach. he barricaded himself in his mother's home after a two-hour standoff. it ended after he shot his mother and himself. the doctor is expected to survive. a surprising twist in a story about a washington state woman about acid burns on her

face. police say she made up the story about someone throwing the acid at her. the 28-year-old admitted she disfigured her own face. it is not clear why. the confession came after police spent hundreds of hours on the case. prosecutors will decide if they will file charges for filing a false police report. uc region -- regents voted yesterday while people protested changes to the pension fund. the workers will increase what they pay to the pensions from 2% to 5%. however, the workers say that will hurt those that make the least amount of money. the university is also planning to increase the contributions from 4% to 10%. there a new poll out this morning that shows a surprisingly tight race to become the next mayor of

oakland with 10 candidates vying for the top spot. emc research conducted this poll for the oakland chamber of commerce. it shows that don perata is leading the race with 26% support. the poll shows that jean kwan has 22% of the support and caplain has 12%. you can find complete information on the debate set for next thursday night. go to the election 2010 tab at ktvu.com. 5:49. sal is starting with the san mateo bridge. what is going on? >> i like that bridge. you notice when we look at this bridge, it doesn't have a lot of fog on it, but the bay bridge does. if you don't like driving in fog -- i don't know if it bothers you that much, you can

good morning. time is 5:55. the fbi investigating a bomb scare on a flight bound for hawaii. the threat was made before the hawaiian airlines flight was due to take off from los angeles. the flight was searched and passengers were rescreened. no bomb was found. there was a two-hour delay for the passengers. pg&e faces a hefty fine for the death of one of the workers. 26-year-old max martinez was electrocuted in march while working on an underground vault. part of the investigation revealed that protection for safety for the employees was lacking. pg&e has been fined more than
